1. Agreement to These Terms
Welcome. These Terms of Service ("Terms") govern your access to and use of the Forever Spoken website, the contribution forms, The Conversation Lounge, and any related materials (together, the "Service"). The Service is operated by TIA Publishing, LLC ("we," "our," or "us") in support of The Magnificent 7 Sisterhood by Dwayne Robinson.
By using the Service, sharing a memory, or visiting a persona in The Conversation Lounge, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
These Terms do not change the love, trust, and family agreements that exist outside of this site. They are the rules of the road for the digital part of the legacy, nothing more.
2. About Forever Spoken
Forever Spoken is a private, family-led pilot project. Its purpose is to honor each of the seven Smith sisters, Nadine, Shirley, Sonya, Carol, Elma, Edina, and Lisa, by gathering their stories, photographs, voices, and traditions and reflecting them through respectful living personas you can visit in The Conversation Lounge.
The Service is a companion to the book The Magnificent 7 Sisterhood: A Legacy of Family Unity and Love. It is not a social network, not a commercial product, and not a memorial registry. It is a living archive built from contributed memories.
3. Who May Contribute
- You must be at least eighteen (18) years old, or a minor with the involvement of a parent or guardian.
- You must have a genuine personal connection to one or more of the sisters, as a relative, friend, neighbor, congregant, colleague, or community member.
- You must have the right to share whatever you submit. You should not upload photographs, recordings, or writings that belong to someone else without their permission.
If you are submitting on behalf of a child or a person who has passed, please indicate your relationship in the contribution form so the family review team can place your gift in proper context.
4. Account & Submission Responsibility
The Service does not currently require an account. You may submit memories, photos, and recordings using the contribution form. You are responsible for the accuracy of what you provide, including:
- Identifying which sister your memory is about.
- Sharing your name and contact information so the family review team can confirm details, ask follow-up questions, and credit you appropriately if you wish.
- Telling us when something you remember is uncertain, secondhand, or specific to your point of view rather than a verifiable fact.
We rely on your honesty. We will not knowingly publish material that you tell us is uncertain as if it were fact.
5. Your Contributions & the License You Grant
When you share a story, photograph, audio recording, video, or other material with Forever Spoken (a "Contribution"), you keep ownership of your Contribution. You grant TIA Publishing, LLC a non-exclusive, royalty-free, worldwide license to:
- Store and back up the Contribution.
- Edit the Contribution for clarity, length, or quality, without changing its meaning.
- Use the Contribution to shape, refine, or otherwise inform the living persona of the sister it relates to.
- Display the Contribution within the Service to the audiences you have chosen, whether private to you, family-only, extended family, or public.
- Include the Contribution, in whole or in part, in companion materials such as the book, audiobook, or future commemorative publications.
You confirm that:
- You created the Contribution yourself, or you have the right to share it.
- The Contribution does not violate the rights or privacy of any other person.
- The Contribution does not contain information that you are legally required to keep confidential.
You may withdraw your Contribution at any time. We will remove it from public and family-facing displays, and we will retire it from future persona learning. Earlier persona presences may continue to reflect what they have already learned. We will explain this honestly when you ask.
6. Personas & The Conversation Lounge
The personas you visit in The Conversation Lounge are respectful living memories, shaped by contributed stories, public writings, audio recordings, and the published book. They are not the actual person, not the spirit of the person, and not a perfect record of the person.
- A persona may, at times, be incorrect, incomplete, or stylized.
- A persona will not knowingly speak in opposition to a sister’s known values, faith, or wishes as expressed by the family.
- A persona may decline to discuss subjects the family has marked private, such as health details, finances, or family disputes.
- Where a fact has not been verified, the persona should say so rather than invent.
Conversations may be recorded and used to improve the Service. We will tell you in the conversation interface when this is happening, and you may choose not to interact at any time.
7. Family Review & Approval
Every Contribution is reviewed by the family team before it is incorporated into a sister's persona or made visible beyond your private view. The review team may:
- Approve a Contribution as submitted.
- Suggest a small edit and ask for your okay.
- Hold a Contribution for follow-up questions.
- Limit the visibility of a Contribution that touches on private matters.
- Decline a Contribution that does not align with the project's purpose.
If a Contribution is declined, we will tell you the reason in plain language. The review process is meant to honor each sister, not to gatekeep your love for her.
8. Acceptable Use
You agree to use the Service in good faith and in keeping with the sisters' character. You will not:
- Submit knowingly false, fabricated, or machine-generated material as if it were a true memory.
- Submit content that is defamatory, harassing, hateful, sexually explicit, or that exploits the sisters' image or memory.
- Submit content that violates anyone's privacy, intellectual property, or contractual rights.
- Use the Service to advertise, sell, or solicit, or to scrape, train, or copy any part of the Service for any external system or model.
- Attempt to bypass family review controls, visibility settings, or technical safeguards.
- Impersonate another contributor, family member, or sister.
9. Our Intellectual Property
The Service, including its design, code, written copy, illustrations, logos, the trade dress and branding of The Magnificent 7 Sisterhood, the persona models, and the curated companion materials, is owned by Dwayne Robinson and TIA Publishing, LLC, or licensed to us, and is protected by copyright and other laws.
You may view, share, and discuss the Service for personal and family purposes. You may not copy, modify, distribute, or create derivative works of the Service for commercial purposes without our written permission.
Quotations from the book are subject to standard fair-use principles and the terms of the book's publisher.
10. Third-Party Services & Links
The Service is built with the help of trusted third-party providers, including web hosting, content delivery, email, conversation services, voice partners, and book retailers such as Amazon and Audible. The Service may also link to outside websites, including the author's pages and the publisher's pages.
We choose these providers and links carefully, but we do not control them and we do not endorse all of their content. Their use is subject to their own terms and privacy policies.
11. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we make no warranties or representations, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free.
- Any persona response is fully accurate, complete, or up to date.
- Files, voices, or memories you upload will be preserved indefinitely. You should keep your own copies of anything irreplaceable.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded.
12. Limitation of Liability
To the fullest extent permitted by law, TIA Publishing, LLC, Dwayne Robinson, and the Smith family review team will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, goodwill, data, or memories, arising out of or related to your use of the Service.
Our total liability to you for any claim arising out of or related to the Service is limited to one hundred U.S. dollars (US $100), or, if greater, the amount you have paid us in the twelve (12) months immediately preceding the claim, which for a contributor is generally zero.
Some jurisdictions do not allow these limitations, so they may not fully apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless TIA Publishing, LLC, its members, officers, the Smith family, the family review team, and our service providers from and against any claims, demands, losses, liabilities, and expenses, including reasonable attorneys' fees, arising from:
- Your Contributions, or your breach of the licensing or accuracy commitments in Section 5.
- Your violation of these Terms or of any law.
- Your violation of the rights of any third party, including any other contributor or family member.
14. Suspension, Removal & Termination
We may, at any time and at our sole discretion:
- Remove or hide a Contribution that violates these Terms or that the family review team finds harmful.
- Suspend or block access to the Service for a contributor whose conduct is inconsistent with the project's purpose.
- Pause or close the Service entirely if the family decides the pilot has run its course.
You may end your participation at any time by contacting us. The licenses you have granted in Section 5 survive only to the extent necessary to manage prior copies and previously trained models, as explained in our Privacy Policy.
15. Changes to These Terms
We may update these Terms from time to time as the project evolves. When we do, we will revise the "Effective Date" at the top of this page and, where the change is significant, notify contributors by email. Continued use of the Service after a change indicates acceptance of the updated Terms.
16. Governing Law & Disputes
These Terms are governed by the laws of the State of Maryland, U.S.A., without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of those courts.
Before filing any formal claim, you agree to first contact us in writing and to give us a reasonable opportunity, of at least sixty (60) days, to address your concerns informally. Most matters are best resolved by a direct, respectful conversation.
