The agreement that governs how we and our stewards work together to keep voices and knowledge in faithful, ongoing conversation.

These Terms of Service govern your access to and use of the Forever Spoken platform, websites, and services operated by Forever Spoken, LLC. By using the service you agree to these terms.

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. Stewards acting on behalf of an organization warrant that they have authority to bind that organization.

You are responsible for the accuracy of account information, the security of credentials, and the actions of authorized users under your account. Stewards are responsible for the lawful basis, consent, and provenance of source materials they contribute.

You may not use Forever Spoken to misrepresent a person without their consent or the consent of an authorized steward, to harass, defame, or harm any person, to violate intellectual property or privacy rights, to build a deceased-subject representation outside our governance process, or for any illegal purpose.

You retain ownership of source materials you contribute. You grant Forever Spoken a limited license to use those materials to operate the service, build the LifeCache, and deliver the conversation experiences you request. We do not use your materials to train general-purpose foundation models.

Forever Spoken builds representations of identified subjects under stewardship. We do not warrant that any representation captures every aspect of a subject, and we maintain explicit guardrails about what a representation will and will not assert. Stewards remain responsible for review and sign-off prior to publication.

Paid plans are billed per the order form or subscription page presented at sign-up. Fees are non-refundable except as required by law or expressly stated.

You may terminate by canceling your subscription or by written notice. We may suspend or terminate for material breach of these terms, for risk to other users or the platform, or as required by law. Upon termination, source materials are returned or destroyed per your instruction within a reasonable wind-down period.

The service is provided on an 'as is' and 'as available' basis. To the maximum extent permitted by law, Forever Spoken disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Forever Spoken will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profit, or revenue. Our aggregate liability is limited to the fees you paid to us in the 12 months preceding the claim.

You agree to indemnify and hold Forever Spoken harmless from claims arising out of your contributed materials, your use of the service in violation of these terms, or your violation of any law or third-party right.

These terms are governed by the laws of the State of Maryland, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Maryland, unless required to be heard elsewhere by law.

We may update these terms. Material changes will be communicated to active stewards. Continued use after changes take effect constitutes acceptance.
